By creating an account, accessing, or using PsychPod (“the Service,” “the App”), you (“User,” “you”) agree to be legally bound by these Terms of Service (“Terms”), our Privacy Policy, and all applicable laws and regulations. If you do not agree to these Terms, you must not use the Service.
These Terms constitute a legally binding agreement between you and PsychPod (“we,” “us,” “our,” “the Company,” “the Developer”). You acknowledge that you have read, understood, and agree to be bound by these Terms.
We reserve the right to update these Terms at any time. Continued use of the Service after any modification constitutes your acceptance of the revised Terms. If you do not agree to the modified Terms, you must discontinue use of the Service immediately.
PsychPod is a personal wellbeing self-tracking tool that allows users to log daily self-report check-ins across multiple wellness domains (sleep, mood, energy, calm, focus, social connection, wellbeing, and contextual factors). The Service also provides pattern analysis, habit tracking, voice journaling, social features (friends, messages), and an achievement/badge system.
PSYCHPOD IS NOT A MEDICAL DEVICE, THERAPEUTIC SERVICE, OR HEALTHCARE PROVIDER.
The Service does not provide medical advice, psychiatric care, psychological counselling, therapy, diagnosis, or treatment of any kind. The Service does not establish any therapist-patient, doctor-patient, counsellor-client, or any other professional healthcare relationship between PsychPod and any User.
Any scores, patterns, insights, or analysis provided by the Service, including any content generated by artificial intelligence, are for informational and self-reflection purposes only and should never be used as a substitute for professional medical or mental health advice, diagnosis, or treatment.
You must be at least 18 years of age to use the Service. By using the Service, you represent and warrant that you are at least 18 years old. If you are between the ages of 16 and 17, you may use the Service only with the express consent and supervision of your parent or legal guardian, who must review and agree to these Terms on your behalf. Your parent or legal guardian is responsible for your use of the Service and assumes all liability thereunder.
If we become aware that a user is under 16, we will immediately terminate their account and delete all associated data in accordance with applicable child protection laws, including Qatar’s Child Law (Law No. 25 of 2007), the Qatar Personal Data Protection Law (Decree-Law No. 13 of 2016), and the EU General Data Protection Regulation (GDPR).
You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must immediately notify us of any unauthorized use of your account or any other breach of security.
We shall not be liable for any loss or damage arising from your failure to comply with this section, including but not limited to losses resulting from unauthorized access to your account.

WE EXPRESSLY DISCLAIM ALL LIABILITY FOR ANY HARM, INJURY, DEATH, OR DAMAGE OF ANY KIND ARISING FROM OR RELATED TO A USER’S MENTAL HEALTH CONDITION, SELF-HARM, SUICIDAL IDEATION, OR ANY ACTIONS TAKEN OR NOT TAKEN BASED ON THE USE OF THIS SERVICE.

You are solely responsible for all content you create, transmit, or display through the Service, including but not limited to messages, journal entries, profile information, and uploaded images. We assume no liability for user-generated content.
We reserve the right, but are not obligated, to review, monitor, or moderate user-generated content, including profile pictures, messages, and any other content shared through the Service. We may, at our sole discretion, remove content that violates these Terms or is otherwise objectionable.
You acknowledge that we cannot guarantee the accuracy, quality, or safety of user-generated content, and we expressly disclaim all liability related to such content.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL PSYCHPOD, ITS DEVELOPER(S), OWNER(S), OPERATOR(S), OFFICER(S), DIRECTOR(S), EMPLOYEE(S), AGENT(S), AFFILIATE(S), SUCCESSOR(S), OR ASSIGN(S) BE LIABLE FOR ANY:
THIS LIMITATION OF LIABILITY APPLIES WHETHER THE ALLEGED LIABILITY IS BASED ON CONTRACT, TORT (INCLUDING NEGLIGENCE AND STRICT LIABILITY), WARRANTY, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN JURISDICTIONS WHERE THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES IS NOT PERMITTED, OUR LIABILITY SHALL BE LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.
IN NO EVENT SHALL OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATING TO THE SERVICE EXCEED THE AMOUNT YOU HAVE PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR TEN (10) QATARI RIYALS (QAR 10), WHICHEVER IS GREATER.

You may withdraw this consent at any time by deleting your account through the Settings menu. Upon withdrawal, all your personal data will be deleted from our systems and third-party services.
In accordance with Article 9 of the Qatar PDPL and Article 7 of the GDPR (where applicable), you have the right to withdraw your consent to the processing of your personal data at any time. THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, RELIABILITY, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.

You agree to indemnify, defend, and hold harmless PsychPod, its developer(s), owner(s), officer(s), director(s), employee(s), agent(s), licensors, service providers, and affiliate(s) from and against any and all claims, demands, actions, suits, proceedings, losses, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees and court costs) arising out of or relating to:
This indemnification obligation shall survive the termination of your account and these Terms.
All content, features, and functionality of the Service, including but not limited to software, code, text, graphics, logos, icons, images, audio clips, data compilations, and design, are owned by PsychPod or its licensors and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.
You retain ownership of any content you create within the Service (journal entries, voice notes, messages). However, you grant us a non-exclusive, royalty-free, worldwide license to store, process, and display such content solely for the purpose of providing the Service to you.
We may suspend or terminate your account at any time, with or without cause, and with or without notice, at our sole discretion. You may delete your account at any time through the Settings menu in the App.
Upon termination, your right to use the Service ceases immediately. Sections of these Terms that by their nature should survive termination (including, without limitation, Limitation of Liability, Indemnification, No Warranty, Dispute Resolution, and Governing Law) shall survive termination.
These Terms shall be governed by and construed in accordance with the laws of the State of Qatar, without regard to its conflict of law provisions.
ANY DISPUTE, CONTROVERSY, OR CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL BE FINALLY SETTLED BY BINDING ARBITRATION ADMINISTERED BY THE QATAR INTERNATIONAL COURT AND DISPUTE RESOLUTION CENTRE (QICDRC), IN ACCORDANCE WITH ITS RULES THEN IN EFFECT.
The arbitration shall be conducted in the English language. The seat of arbitration shall be Doha, Qatar. The award rendered by the arbitrator(s) shall be final and binding, and judgment on the award may be entered in any court of competent jurisdiction.
YOU AGREE THAT ANY ARBITRATION OR LEGAL PROCEEDING SHALL BE CONDUCTED ON AN INDIVIDUAL BASIS AND NOT AS A CLASS ACTION, COLLECTIVE ACTION, OR REPRESENTATIVE ACTION. YOU WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION AGAINST PSYCHPOD.
Any claim or cause of action arising out of or related to the Service or these Terms must be filed within one (1) year after such claim or cause of action arose, or the claim is permanently barred.
The Service utilizes third-party services including but not limited to Supabase (database and authentication), Anthropic/Claude (AI analysis), Expo/EAS (app infrastructure), Apple (iOS distribution), and Google (Android distribution). We are not responsible for the practices, policies, or actions of these third parties, and your use of their services is subject to their respective terms and conditions.
We shall not be liable for any failure or delay in performing our obligations under these Terms due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, riots, pandemics, epidemics, government actions, sanctions, embargoes, power outages, internet or telecommunications failures, or cyberattacks.
If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it enforceable, or if modification is not possible, it shall be severed from these Terms. The remaining provisions shall continue in full force and effect.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and PsychPod regarding the Service and supersede all prior agreements, understandings, and communications, whether written or oral, relating to the subject matter hereof.
